BYLAW MAKING

UPDATE (16 December 2008):

This version of the module was published in December 2008.  The changes made have not substantively changed the content of the module.  This is still the same as when the module was first published on 2 November 2007.  Existing hard copies of the previous version need not be discarded and replaced.  Rather they are improvements to the format to improve its usability.  This has included numbering of "hot tips" for ease of reference, and the addition of links to sections of the legislation wherever these are referenced.  The next regular review of the content of the module is scheduled for the first half of the 2008/09 year.  All suggestions for improvements, and all offers assistance with the review process gratefully accepted.

Contents of the Module

Part 8 subpart 1 of the Local Government Act 2002 contains general provisions relating to local authority bylaws.  This includes specific provisions relating to the process for adopting bylaws (including the use of the special consultative procedure), factors to be taken into account in considering the adoption of bylaws, and a requirement for the periodic review of bylaws.  This module is an aid to local authorities in complying with these provisions.  The topics addressed are:
